FTC Rule

On August 20, 2024, a Texas federal judge granted an injunction against the FTC Rule banning non-compete agreements which was set to go into effect on September 4, 2024. The Texas court ruled that the FTC exceeded its authority in enacting the rule and found that the rule itself was arbitrary and capricious.

This means that for now the FTC Rule will not go into effect on September 4, 2024. It is possible that the FTC will appeal to the Federal Fifth Circuit Court of Appeals.

We will continue to watch for any appeals and any other action related to this Final Rule.
